"X"  equals the employer's pro-rated liability for attorney's fees and expenses

"Employer's Reduced Liability" represents the amount paid in past work comp benefits

"Third-Party Recovery" the full amount of third party settlement

"Attorney Fees and Expenses" the Plaintiff's attorney fee plus expenses incurred

 

After the formula is applied to determine the pro-rated attorney fees and expenses  "X" is subtracted from past benefits paid to obtain your net subrogation recovery
