IN-HOUSE ATTORNEY SERVICES

Our in-house legal counsel has been overseeing, monitoring and directing the administration of claims for our clients since 1990.  For ten years prior to joining us, he was a practicing trial attorney for the plaintiff’s bar.  Due to this previous experience, he knows the plaintiff’s attorneys and judges in Alabama, he has the ability of knowing what the plaintiff’s attorney is going to do, going to say and how he will manipulate the doctors before they ever take action to implement their case theory on a particular file.  Most importantly, files are set up in anticipation of litigation (e.g. early surveillance, early direction to doctors, etc.).  We structure the files to build a defense for the workers compensation portion and at the same time, structure the defense for any American’s with Disability Act litigation that may occur subsequent to the conclusion of the workers compensation claim.

We at Millennium Risk Managers are team players with every aspect of claims administration.  This includes our approach to defending claims. While we have excellent relationships with select attorneys across the state, we can work well with any attorney that the client is comfortable with and desires to use.

Millennium Risk Managers’ in-house counsel works closely with the “decision maker” of the account.  He will report directly to the “decision maker” by giving complete fact reviews with upper and lower dollar figure exposure levels on any one particular file that is moving to settlement and/or litigation.  This exposure level takes into consideration many factors, the more important of which are as follows:

 

1.                  Deposition testimony and/or doctor report

2.                  Surveillance results

            3.                  The judge (Democratic or Republican)

            4.                  The election year

            5.                  Past experience of judge’s tendency to rule for or against the given facts situation

            6.                  The appellate success prospects
